Terms of Service

These terms of service (“Terms”) govern your use of the Hoekk mobile application and website (together, the “Service”) operated by Hoekk, a sole proprietorship based in The Netherlands. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of service

Hoekk helps users find rental apartments in The Netherlands. The Service aggregates publicly available rental listing data and uses artificial intelligence to generate personalised inquiry emails on your behalf. When you connect your Gmail account, the Service can send these emails directly from your Gmail and notify you when agents reply.

2. Eligibility

• You must be at least 18 years old to use the Service.
• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the confidentiality of your account credentials.

3. Account and authentication

You may create an account using an email address and password, or by signing in with Apple. You are responsible for all activity that occurs under your account. Notify us immediately at support@hoekk.com if you suspect unauthorised access.

4. Gmail authorisation

Connecting your Gmail account is optional but required to send inquiry emails. When you connect Gmail:

• You grant Hoekk permission to send emails on your behalf using the gmail.send scope.
• You grant Hoekk permission to check for agent replies using the gmail.readonly scope. We only read threads originating from emails we sent — we never access any other messages.
• You can revoke access at any time by disconnecting Gmail in the app, which immediately deletes your stored tokens.

You acknowledge that emails sent through the Service are sent from your Gmail account and appear as if you wrote them. You are responsible for the emails sent on your behalf.

5. AI-generated content

Inquiry emails are generated by artificial intelligence (Anthropic Claude) based on your profile and the listing details. While we strive for accurate, professional emails in Dutch:

• AI-generated text may contain errors, inaccuracies, or inappropriate content.
• We recommend reviewing generated emails before they are sent, where the feature is available.
• Hoekk does not guarantee that emails will be delivered, that agents will read them, or that you will receive responses.
• Hoekk is not responsible for the content of AI-generated emails or any consequences arising from their delivery.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Send spam, harassing, misleading, or fraudulent messages
• Attempt to access other users’ accounts or data
• Reverse-engineer, scrape, or interfere with the Service’s operation
• Use the Service to collect personal data about rental agents or other users for purposes unrelated to finding housing
• Create multiple accounts to circumvent usage limits

7. Subscriptions and payments

Hoekk offers free and paid tiers:

• Free: limited to 3 AI-generated emails per week
• Pro (monthly): unlimited emails and additional features
• Pro (annual): same as Pro monthly at a discounted annual rate

Paid subscriptions are managed through the Apple App Store. Billing, renewal, and refunds are handled by Apple in accordance with their terms and refund policies. Prices may change with reasonable notice.

8. Listing data

Listing data displayed in the Service is sourced from third-party platforms and is provided for informational purposes only. We do not guarantee:

• The accuracy, completeness, or timeliness of listing information
• The availability of any listed property
• The identity or trustworthiness of rental agents

Always verify listing details independently before entering into any rental agreement.

9. Intellectual property

• The Hoekk name, logo, and Service design are our intellectual property.
• Listing data belongs to its respective sources.
• AI-generated email text is created for your personal use in contacting rental agents.
• Your profile data remains yours. We use it only to provide and improve the Service.

10. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Listing data will be accurate or up to date
• AI-generated emails will be error-free or achieve any particular outcome
• Emails will be delivered or that agents will respond

11. Limitation of liability

To the maximum extent permitted by Dutch law, Hoekk and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. This includes, without limitation, damages for lost opportunities, failed rental applications, or incorrect email content.

Our total aggregate liability for any claims arising from the Service is limited to the amount you have paid for the Service in the 12 months preceding the claim, or €100, whichever is greater.

12. Termination

• You may delete your account at any time from within the app or by contacting support@hoekk.com. Deletion permanently removes all your data.
• We reserve the right to suspend or terminate accounts that violate these Terms, abuse the Service, or harm other users.
• Upon termination, your right to use the Service ceases immediately. Sections 10, 11, and 13 survive termination.

13. Governing law and disputes

These Terms are governed by the laws of The Netherlands. Any disputes arising from these Terms or the Service shall be submitted to the competent court in The Netherlands. If you are a consumer in the EU, you retain any mandatory consumer protection rights under the law of your country of residence.

14. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or via email at least 14 days before the changes take effect. Continued use of the Service after changes constitutes acceptance. If you do not agree with the updated Terms, you should stop using the Service and delete your account.
